The Sindh High Court (SHC) has intervened to address the severe traffic woes of Karachi residents, issuing a strict two-month ultimatum to the provincial government to restore University Road to a fully functional state.

Key Judicial Directives

A constitutional bench, consisting of Justice Muhammad Saleem Jessar and Justice Nasir Ahmed Bhanbhro, laid out several critical orders to resolve the ongoing infrastructure crisis:

  • Road Restoration: The court directed the Sindh government to repair University Road within two months, emphasizing that the general public and students have suffered significantly due to the road's dilapidated condition.

  • BRT Red Line Project: While the court was informed that the project's completion date has shifted to October 2027, it made it clear that construction work must not obstruct the smooth flow of traffic on University Road.

  • Additional Funding: The bench requested the government to allocate extra funds specifically for the thoroughfare’s urgent restoration.

Legal Ruling on Contract and Machinery

The court's decision came while disposing of a petition by a private construction firm whose contract was recently terminated.

  • Machinery Dispute: The bench declared the sealing of the construction company’s machinery by the Karachi Metropolitan Corporation (KMC) as illegal.

  • Resolution Process: If TransKarachi (the project lead) wishes to retain the machinery based on the contract, they must approach a dispute resolution board. If no decision is reached within 30 days, the equipment must be returned to the petitioner.

  • Land Possession: Regarding the 10-acre camp site near Aladdin Park, the court ruled that since the lease had expired and the land owner was not a party to the case, the KMC’s repossession of the land would stand.
