The Supreme Court has scheduled a hearing of criminal petitions related to the Toshakhana case against Pakistan Tehreek-i-Insaf (PTI) founder Imran Khan, following the completion of proceedings in the Islamabad High Court (IHC).
A two-member bench headed by Chief Justice Yahya Afridi will hear the petitions, with Justice Shahid Bilal Hassan as the other member of the bench. The hearing is scheduled for February 9.
The petitions challenge the trial court proceedings in the Toshakhana case, in which Imran Khan was sentenced to three years’ imprisonment under Sections 167 and 173 of the Election Act.
Earlier, the Islamabad High Court had suspended the sentence awarded by the trial court, providing relief to the PTI founder while legal proceedings continued.
According to the petitions, the trial court failed to comply with the IHC’s remand order and did not follow the high court’s instructions. The petitioners argue that the trial court’s decision, issued after the IHC’s order, amounted to an excess of legal authority and should therefore be declared illegal.
The Supreme Court had previously adjourned the hearing of the case in August 2023 while an application for suspension of sentence was pending before the Islamabad High Court.
With the high court proceedings now concluded, the apex court is set to resume hearing the matter, which remains one of the most closely watched legal cases involving the former prime minister.
